Publication of law on LGBTI inclusion in the workplace
External practice
Duration
Published 08/10/24 but ongoing
Partnership
Ministry of Work, Employers' organisations, other Trade Unions
Reason it was developed
Leading on from earlier legislation on gender equality, this legislation was developed to tackle discrimination against members of the LGBTI community in the workplace.
Activities
Publication of law RD 1026/2024 of 8th October - which aims to eliminate discrimination against LGBTI workers in companies and obliges companies with more than 50 workers to implement and finance measures to ensure equality, and includes the need for protocols on how to act in cases of bullying or violence against members of the LGBTI community. The law is the result of a tripartite dialogue with the Ministry of Work, Employers' organisations and Trade Unions (including CCOO). The law places the emphasis on agreement of the measures predominantly at the sectorial collective agreement level and that will be the next priority for FECCOO .
Results
The challenge is now to implement the law and bring about results that reduce and eliminate discrimination in the workplace. A change that is probably positive is the need to negotiate at sectorial level rather than company level (which is the case with gender equality plans) as this will hopefully be significantly more efficient as well as making it easier to institute common sets of practices within and across sectors.
